General Terms and Conditions of Online Sales

Scope

These General Terms and Conditions govern exclusively the commercial relationship between the clients of Quinta D’Azinheira (hereinafter referred to as the “Client”) and Vinhos, Quinta D’Azinheira, Lda., VAT number 508 955 971, headquartered at Quinta da Azinheira, S/N, Azinheira, Alvações do Corgo, Santa Marta de Penaguião, Vila Real (hereinafter referred to as “Quinta D’Azinheira”).

These General Terms and Conditions are the only conditions applicable and replace all others, except where otherwise agreed in writing in advance. Quinta D’Azinheira may update these terms occasionally, and for this reason, Clients are advised to read them whenever purchasing products or booking services through the website www.quintadazinheira.com (hereinafter referred to as the “Website”).

Submitting an order or booking request through the Website implies full knowledge and acceptance of these General Terms and Conditions, which govern all commercial relationships established through the Website between the Client and Quinta D’Azinheira (hereinafter referred to as the “Online Terms and Conditions of Sale”).

1. THE PARTIES

1.1. The Website is owned by Quinta D’Azinheira.

1.2. These Online Terms and Conditions regulate the purchase of products and the booking of experiences through the Website.

1.3. The Client will be identified through the information provided in the order form available in the “Wine” section, for the purchase of wines produced by Quinta D’Azinheira (hereinafter referred to as “Product(s)” or “Order(s)”), or in the “Emotions” section, for the booking of experiences provided by and at Quinta D’Azinheira (hereinafter referred to as “Booking(s)”, “Experience(s)” or “Service(s)”).

The information provided by the Client is their sole responsibility, and Quinta D’Azinheira cannot be held liable for any failure in the sale of Products or provision of Services resulting from incomplete, incorrect, or false information.

1.4. The Products and Services available on the Website are intended for adult clients only. By placing an Order or making a Booking through the Website, the user confirms that they are over 18 years of age, have the legal capacity to enter into binding agreements, and meet the legal drinking age requirements of their country of residence.

2. ORDERING PRODUCTS OR BOOKING EXPERIENCES

2.1. Before placing an Order or requesting an Experience Booking at Quinta D’Azinheira, the Client should carefully review these Online Terms and Conditions.

2.2. To purchase Products or Services, the Client must complete the form referred to in section 1.3.

After completing and submitting the form with personal information and the details of the Order or Booking, the Client will receive an email at the provided contact address containing all relevant details, including delivery conditions, shipping costs, invoicing information, payment instructions, prices, Products, or Services, where applicable.

Once payment has been successfully received, the Product will be shipped. The Client will receive an email confirming shipment. Until that moment, no contract exists between the Client and Quinta D’Azinheira.

For Bookings, availability for the requested date will be confirmed by email within 48 hours of the submission request.

Quinta D’Azinheira recommends that all Clients verify the information provided in the form. If the Client does not receive an order confirmation or booking confirmation email within 48 hours, they should contact Quinta D’Azinheira through the following contacts: telephone (+351) 910 923 434 (national mobile network call) or email quintadazinheira@quintadazinheira.pt.

2.3. Orders will be dispatched within a maximum period of 5 business days after payment confirmation.

2.4. Quinta D’Azinheira may, whenever deemed necessary, request additional information regarding an Order or Booking via email or telephone before confirming the Order, shipment, or requested Booking.

2.5. Quinta D’Azinheira reserves the right not to process Orders or Booking requests that raise doubts, are incomplete, or where it is impossible to contact the Client due to incomplete, false, or incorrect personal information.

2.6. Should Quinta D’Azinheira become unable to fulfil its obligations due to sudden stock shortages or any other exceptional circumstance, it undertakes, after verifying the impediment, to:
i) inform the Client within 48 hours;
ii) refund any amounts already paid within a maximum period of 5 business days.

2.7. Quinta D’Azinheira reserves the right to refuse an Order or Booking from a Client with whom there is an ongoing dispute related to a previous Order or Booking, or if the Client is considered unsuitable, including previous breaches of these Online Terms and Conditions.

3. PHOTOGRAPHS, IMAGES AND PRODUCT REPRESENTATIONS

Quinta D’Azinheira will make every effort to ensure that the photographs and images displayed on the Website accurately represent its products and spaces. However, it cannot be held responsible for any distortions or differences resulting from screen colour or image display settings used by Website visitors.

4. SALE PRICES

All prices displayed on the Website are in Euros, including taxes and applicable fees, but excluding shipping costs.

Quinta D’Azinheira reserves the right to change prices without prior notice. However, the price applicable to the Client will always be the one in effect at the time of the Order or Booking.

5. SHIPPING COSTS

Shipping costs and any applicable delivery fees will be specified in the order confirmation.

In the event of cancellation after payment, the conditions set out in our Returns Policy shall apply.

6. ORDER DELIVERY

6.1. Products may be delivered in Portugal and abroad, although restrictions may apply to certain destinations, subject to case-by-case assessment by Quinta D’Azinheira. Orders will be delivered to the address provided by the Client in the Order form.

6.2. Deliveries will only take place on business days.

6.3. It is the Client’s responsibility to inspect the packaging upon delivery and verify whether any visible damage exists (for example: wet or damaged boxes). In the event of anomalies, the Client must ensure that such issues are noted by the carrier and immediately reported to Quinta D’Azinheira.

Quinta D’Azinheira uses third-party shipping providers. If an Order is lost or arrives damaged, Quinta D’Azinheira will either refund the Client or send a replacement product.

After receiving the Products, if the Client detects any processing error, Quinta D’Azinheira must be informed immediately.

7. AVAILABILITY

If, due to a technical error, the sale of an out-of-stock product is confirmed, Quinta D’Azinheira undertakes to refund any amount previously paid (see section 2.6).

8. PAYMENT METHODS

When placing an Order or Booking through the form available on the Website, the Client will receive payment instructions. Payment must be made by bank transfer to the IBAN provided by Quinta D’Azinheira.

Orders will be cancelled if payment is not made within 48 hours after receiving the payment instructions. Bookings will be cancelled if payment is not made within 48 hours after availability confirmation.

Orders will only be processed after successful payment confirmation.

9. RETURNS

9.1. If the Client wishes to exercise the right of return, Products must be returned within 14 consecutive days from the date of delivery. The decision to return must be communicated to Quinta D’Azinheira prior to shipment.

9.2. Products must be returned exactly as shipped, complete with all labels and packaging. In the event of an Order or shipping error (for example, incorrect product delivery), the incorrect product must be returned intact.

9.3. When the right of return is exercised, Quinta D’Azinheira will issue the refund within a maximum period of 14 days from the date the returned product arrives at Quinta D’Azinheira’s facilities.

The Client will be refunded using the same payment method used for the original transaction.

Return shipping costs are the responsibility of the Client, except in cases of error or defect attributable to Quinta D’Azinheira.

9.4.

If the right of withdrawal is exercised without complying with the procedures described in this section 9, the Client shall not be entitled to any refund. Within 10 days following notification of the refusal of the return and the relevant reasons, the Client may, by replying to the same email, choose to recover the returned products at their own shipping expense. Otherwise, Quinta D’Azinheira may lawfully retain the returned products, in addition to the amount already paid for the purchase.

10. CANCELLATION OF PRODUCT ORDERS AND SERVICE BOOKINGS

Order cancellations may only be accepted if the cancellation request is sent by email to Quinta D’Azinheira before the Product has been shipped. For cancellations after shipment, our Returns Policy shall apply.

Service cancellations must be made up to 3 business days before the scheduled date of the selected experience. After this deadline, our Returns Policy shall apply.

11. WARRANTIES

All Products sold benefit from the legal warranty provided by applicable law.

Quinta D’Azinheira undertakes to carry out repairs whenever applicable. To activate the warranty, the Client must provide a copy of the invoice. If repair or replacement is not possible, the Client shall be entitled to terminate the purchase agreement and receive a refund upon returning the purchased product, whenever applicable.

The warranty does not cover:

  • Abnormal or improper use of the products;
  • Damage caused by external events.

12. DISPUTES

For the resolution of any dispute arising from the interpretation or execution of these Online Terms and Conditions, we recommend first contacting Quinta D’Azinheira so that we may seek an amicable and fair solution together.

Should the dispute remain unresolved, the Client may resort to a recognised Alternative Dispute Resolution (ADR) entity, in accordance with Portuguese Law no. 144/2015 of 8 September, as amended.
